Phenix City planning authority outside city limits returns to Lee County, staff say

County highway and planning staff told the commission that a prior agreement allowing Phenix City to exercise a 1.5-mile planning jurisdiction for subdivisions outside its city limits will end and that the county will resume sole regulatory authority for subdivisions outside the city limits.
"The commission sent a letter in August giving them a deadline of February 28, 2026 to end the agreement and begin sole authority for subdivision regulation in the county beginning March 1," the county planner (Patrick) said, adding that the date has passed and staff are notifying engineers and surveyors of the change.
Commissioner Jeff Drury said the change restores local control to Lee County and pushed back against the idea of "regulation without representation," noting developers and builders had welcomed the move.
Staff emphasized the item was informational and required no action; the county and Phenix City are each notifying surveyors and engineers of the change so developers know the county will handle subdivision sign-offs outside the city limits going forward.
