Summary
Commerce City renewed conditional use permits for A1 Organics (mulch/compost piles up to 25 feet) and Recycling Connections (metal recycling), keeping operational conditions (setbacks, dust mitigation, screening) and removing term limits after staff and planning commission recommended approval.
The council approved renewals of two industrial conditional use permits after staff and the Planning Commission recommended continued operation under existing mitigation conditions.
A1 Organics asked to continue storing and processing wood and mulch at 9109 Monaco Street with pile heights up to 25 feet. Applicant representatives said the taller, compact piles reduce wind sensitivity and increase operational efficiency; they noted annual inspections by South Adams County Fire and the Adams County Health Department and said there have been no formal violations. The company agreed to maintain a 500‑foot setback for grinding and a 100‑foot storage setback from residences, keep a 25‑foot demarcation pole on site, maintain paved aisles, have water trucks for dust control, and maintain an 8‑foot net along residential property lines. Council approved the renewal and removed the prior five‑year expiration, making the CUP indefinite unless revoked for noncompliance.
Council also renewed the CUP for Recycling Connections at 9985 E. 104th Avenue. Staff said the metal recycler’s operation is limited to nonhazardous metals, prohibits long‑term storage of crushed cars (72‑hour limit), and includes screening and circulation measures. Planning Commission recommended approval and council approved the renewal with prior conditions and without a term limit.
Council stressed enforcement tools remain available: noncompliance with CUP conditions can prompt hearings and revocation. Several councilmembers thanked the businesses for compliance and community engagement.
