Safety Commission tables consideration of ATV/UTV ordinance after safety concerns

The New Berlin Safety Commission voted 9-0 on Nov. 12 to table consideration of an ordinance that would allow All-Terrain Vehicles (ATVs) and Utility-Terrain Vehicles (UTVs) on city roadways and asked commissioners to review state statutes and sample municipal language ahead of its December meeting. Alderwoman Charlotte Kroupa said she provided commissioners with printed copies of the applicable state statutes, a copy of the City of Muskego's ATV/UTV ordinance and an email from City Attorney Tom Schmitzer for review.
Commissioner Mitchell Lataille said, based on past statistics and discussions, he was not in favor of permitting ATVs and UTVs on New Berlin streets. During public comment, resident Greg Alley, 20650 W. Mill Creek Trail, told the commission he opposed creating such an ordinance and cited concerns about increased injuries from reckless driving, intoxicated or underage operators, vehicle handling and reduced visibility on typical roadways.
Kroupa also noted potential additional costs to the city for installing new signage if the ordinance moved forward. The commission moved to table the item for further study and further discussion at the Dec. 10 Safety Commission meeting; the tabling motion was made by Alderwoman Charlotte Kroupa, seconded by Staff Designee Dave Rocklewitz, and passed 9-0.
The commission did not adopt policy or direct staff to draft ordinance language at this meeting; members were asked to review the materials provided and to bring questions or proposed language back in December.
