Planning commission recommends annexation of 1.84 acres near South 250 West

The Mayfield Town Planning Commission voted March 31 to recommend annexing 1.84 acres petitioned by Pearl Lake Christiansen, after discussion about an overlap in legal descriptions raised by an adjacent owner.

Staff member (S2) opened the item and explained that the map had been revised to exclude contested property. Applicant/Property owner (S3) told the commission that the adjoining deed descriptions “come down to where we got the new line” and that the plat had been sent to the county surveyor for review. The county surveyor had told staff he would not accept a contested legal description and wanted the parties to resolve the overlap before final approval, staff said.

A commissioner moved to approve the annexation as drawn and the motion carried. Staff and the clerk agreed to deliver the signed plat and the intent-to-annex filing to the county clerk and to present the mylar for council signature as part of the certification process.

Commission discussion focused on ensuring the annexation did not create an “island” of unannexed parcels and on resolving the deed overlap through surveyor review and party agreement. No formal protest by the joint property owner had been filed with the county, staff said.

Next steps are administrative: staff will complete filing with the county clerk and coordinate council signatures on the final plat; any unresolved boundary dispute will remain the responsibility of the affected property owners and the county surveyor to address before the county records the annexation.
