Summary
Doña Ana County planning commissioners approved a special-use permit allowing a 1,053-square-foot accessory dwelling at 2055 Rincon De Amigos on a 2.47-acre parcel in the D‑1L zone, after staff reported minimal traffic and infrastructure impacts and noted one letter of opposition.
Doña Ana County planning commissioners voted to approve special-use permit SU26-003, allowing an accessory dwelling unit at 2055 Rincon De Amigos.
Staff presenter Christopher Valencia told the commission the subject parcel is 2.47 acres in the D‑1L zone and the proposed accessory dwelling is 1,053 square feet (heated area 838 square feet). Valencia said water would be provided by Moon Gate and wastewater by an approved septic system, and concluded: “Based on our facts and findings of staff analysis, agency comments, the staff recommends approval of this case, SU26003.”
Valencia said the accessory dwelling would be used by immediate family members and occasional guests, that additional traffic from one residence would be minimal, and that notification requirements had been met. Commissioners asked whether the unit would be rented; the applicant, who affirmed her testimony for the record, said the structure was intended for family occupancy and not rental use.
One letter of opposition was received in the administrative review; staff told the commission it had addressed noticed concerns and found no impacts to sensitive areas, endangered species, or adjacent properties. Commissioner Lier moved to approve the permit “based on finding facts, staff analysis, and staff,” and Commissioner Fisher seconded. A roll call recorded affirmative votes from Commissioners Odonga, Lear and Fisher and Chair Bill Zarges; the motion carried and the permit was approved.
The permit authorizes an accessory dwelling no larger than the zoning limit (1,800 square feet stated in the staff report) on the parcel. Staff said standard building-permit review and conditions will follow on plan review and permit issuance.
The commission moved next to a rezoning matter; no additional conditions or appeals were recorded on SU26-003 during the meeting.
