The board attached four conditions to the permit: the permittee must (1) install and maintain proper erosion control at all outlets; (2) re-establish disturbed areas to prior conditions; (3) obtain an amendment to the permit for any new outlets, alterations to outlet locations, or improvements that would result in drainage of additional acres; and (4) ensure grade from the outlet lift pump to Foster County Assessment Drain No. 1 matches the flow-direction map submitted with the application before operating the outlet lift pump. If grading in the road right-of-way west of 70th Ave NE is necessary to satisfy the grade requirement, the permittee is responsible for obtaining permission from the applicable road authority and underlying landowner.
Rinke Noonan was directed to send the notice of decision to the North Dakota Department of Water Resources (DWR) and to Brandon Gussiaas. The board’s decision was recorded as unanimous; no individual dissenting votes were noted in the meeting minutes.
