Nonoperative-vehicle case extended for resident with health issues; compliance deadline set for Jan. 8

At a Nov. 19 hearing the city presented a nonoperative-vehicle case for 223 Indian Hills Drive involving owner Sharon Rain. City staff entered multiple photographs taken between September and November as exhibits and explained notice attempts. Neighbor Steven Patterson appeared and said he has been helping Rain, describing her mobility and cognitive limitations.
Patterson told the magistrate he had tried to help and that Rain "is very unsteady, and she's morbidly obese, and she's got dementia too" (Steven Patterson, speaker 15). City staff said they had had difficulty communicating directly with Rain but had been in contact with Patterson and others helping the resident. Given the circumstances, staff and the magistrate agreed to a short extension to allow the neighbor or a mechanic to address the vehicle's tires, tag and registration.
The magistrate found that the nuisance condition exists and ordered that the vehicle be removed, registered or repaired and properly tagged by Jan. 8, 2025. Failure to comply will result in a $100-per-day fine for each day the violation continues and the city may abate the nuisance and assess abatement costs to the property. The order includes the standard 30-day right to appeal.
Next steps: the neighbor or representative should work with code-enforcement staff to complete paperwork or repairs and notify the staff of compliance. If compliance is not achieved, the city may pursue abatement and assess costs to the property.
