Council legalizes and conditions permanent patio at 911 Truesdale Street

Eureka — The council voted unanimously April 21 to legalize a permanent covered outdoor patio at 911 Truesdale Street that was erected in 2020 under the city's COVID-era temporary dining rules. Associate Planner Gonzales recommended the conditional approval and reimposition of several prior conditions, and told the council the project's entitlements are appealable to the Coastal Commission.
Gonzales explained the prior conditional use permit and coastal development permit amendments had expired, and staff reanalyzed the project, concluded the required findings can be made, and recommended imposing several conditions: obtain all building and fire permits and clearances prior to opening the patio, implement tribal-monitoring agreements for ground disturbance, require best-management practices to prevent non-stormwater discharges to public rights-of-way, limit construction access to Trousdale, obtain encroachment permits for work in the public right-of-way, and prepare and post a tsunami evacuation plan on site.
Councilmember Moulton confirmed the project would include some ground disturbance for an ADA-compliant pathway and a concrete slab; Gonzales said the work is limited and staff recommended reimposing four original conditions and adding three tribal-monitoring conditions and several new protections.
Councilmember Bauer moved the resolution to find the project exempt from CEQA and conditionally approve the modification to CUP CD-10-0003 and CDP-10-0006; the motion passed 5-0.
The action establishes the design review and entitlements for use of the patio once the applicant secures the required building, fire and encroachment permits.
