Chief Counsel reports new federal lawsuit naming Board Chair and Executive Officer; multiple hearings scheduled

During the April 8 public meeting Chief Counsel Aaron Jackson delivered the Board's litigation update and identified several upcoming hearing dates and pending matters. Jackson reported a hearing on the Board’s demurrer and an employer’s motion for sanctions in Metropolitan News Company is set for April 9, 2026, and a hearing on the Board’s demurrer in the Uber matter is set for April 20, 2026. He said a Drill Tech Drilling & Shoring hearing is scheduled for May 29, 2026 and that the Board is working on its response to the fourth amended petition in Baldi/Arana.
Jackson also told the Board: "The Board was made aware that a new Federal lawsuit has been filed naming Ed Lowry and Scott Pease in their professional capacities as defendants. The Board has still not been served with the complaint." The remark was included as part of the legal-unit update; no additional public comment or response to that statement was recorded in the meeting minutes.
The litigation update also included a list of matters pending in the Superior Court and Appellate Court, which the Clerk read into the record for public notice and to assist stakeholders in tracking ongoing judicial review of Board decisions.
