Council amends Turek Estates developer agreement to preserve existing shared driveway arrangement

The council voted unanimously to approve a first amendment to the Turek Estates developer agreement, revising a 2008 restriction that had limited shared driveway use to family members. The amendment allows the existing shared driveway to continue to be used by a new, non-immediate-family owner provided no additional homes are constructed and a maintenance agreement is in place.
Ken (staff) described the background: the city, the township and the original developer agreed in 2008 to allow four lots to use an existing shared driveway on condition the lots remain in the family. A recent proposed sale to a nonfamily buyer prompted the city and Lanesburg Township to negotiate an amendment permitting the sale while preserving the driveway arrangement so long as no new homes are built and the new owner accepts maintenance responsibilities. The township must also concur at its next meeting for the amendment to be final.
Council moved, seconded and approved the amendment 4-0. Staff said they would take the amendment to the township for recording and finalize documents to be filed.
