Developer reports no soil contamination at Olivia on Marsh Creek site; trees and lead‑containing buildings to be managed

An on‑site engineer told the council that seven soil borings found no contamination at the Olivia on Marsh Creek project, that lead‑containing buildings will be dismantled per best practices, one more tree will be removed and remaining trees protected, and stormwater controls were amended and completed.
City Manager Bret Prebula introduced on‑site engineer A. J. Kennedy to provide a project update on the Olivia on Marsh Creek development. Kennedy said the project team amended the stormwater pollution prevention plan to achieve compliance and added erosion and sediment controls and hydroseeding.
Kennedy reported that seven soil borings to date revealed no contamination. He said buildings containing lead will be dismantled in accordance with best management practices, one more tree will be removed and the remaining trees will be protected. Kennedy also noted that following an earlier weekend tree removal, Mr. Jordan was notified that weekend tree removal is not allowed.
No action was taken; the update was presented for information and to respond to numerous public records requests the city has received regarding the project. Council and staff framed these items as ongoing site management and regulatory compliance steps.
The council did not take legislative or permitting action on the project during the meeting.
