Council approves eminent-domain resolution to acquire right-of-way for Alsbury Phase 2 extension

The Burleson City Council unanimously approved a resolution authorizing staff to begin eminent-domain proceedings to secure right-of-way and utility easements for the Alsbury Phase 2 roadway and utility improvements.

Deputy City Manager Eric Oskerson said the project extends Alsbury Boulevard and includes roadway and utility improvements to mitigate traffic on the city's west side as growth continues toward Chisholm Trail Parkway. Staff reported agreements with seven of the nine affected property owners but said two parcels remain (both listed at 11005 County Road 1020 under the same owner) and the city needs roughly 44,165 square feet overall for the planned improvements, plus a 0.132-acre temporary construction easement. Title searches, legal descriptions and appraisals were completed.

Oskerson said a right-of-way agent had negotiated with owners but the counter-offer on the remaining parcels was significantly higher than the appraisal. If council approves staff will provide initial offers and a bona fide final offer per state law and, if necessary, file eminent-domain proceedings; staff estimated a four to six month timeline for the process if negotiations fail.

A council motion to approve the resolution was seconded and recorded as passing unanimously. Council members expressed support for moving forward without trimming essential scope; some noted that removing protective features or switching to less durable construction would save money but could compromise long-term operational needs.

The resolution authorizes staff to begin eminent-domain proceedings for the Alsbury Phase 2 project once statutory offer obligations are met; staff will return with follow-up information as negotiations progress.
