The Burleson City Council unanimously approved a resolution authorizing staff to initiate eminent-domain proceedings to acquire a permanent utility easement needed to construct a 12-inch water line for the Willow Creek project.
Deputy City Manager Eric Oskerson presented Resolution CSO 5740-20-2025 and said the city agreed terms with one of the two required property owners but needs an easement on the second parcel at 391 Clubhouse Drive (listed in the record as 391 Clubhouse Drive, Joshua, Texas). Staff said approximately 3,961 square feet (about 0.091 acre) is required for a permanent water line easement and that a legal description, title search and appraisal have been completed.
Oskerson told the council that staff and a consultant made multiple attempts to contact the property owner without success; if approved the city will provide an initial offer and a bona fide final offer in compliance with state law and would begin eminent-domain proceedings only if negotiations fail. He estimated the entire process would take roughly four to six months if condemnation becomes necessary.
Council member motioned to approve the resolution and the motion passed unanimously. Staff recommended approval to ensure the project could be completed without the significant cost or delay of redesigning the route.
The resolution authorizes the filing of eminent-domain proceedings once required state-law offer requirements are met; staff will return with next steps and provide required statutory notices to the property owner.
