Mobile County Commission pauses effective date for proposed building-code adoption, schedules public hearing

The Mobile County Commission voted to rescind earlier language that set a May 1 effective date for the proposed adoption of the 2024 International Codes (with 2023 National Electrical Code amendments) and instead scheduled a public hearing before final action.
County staff read the advertisement language and said the codes will be posted on the county website for review. Neil, a county staff member who answered commissioners’ procedural questions, said the advertisement dates will be April 1, 8, 15 and 22 and that the county will hold a public hearing on April 27 with final action to follow at a subsequent commission meeting. "In the advertisement, it reads that the first meeting after the advertisement, we'll hold a public hearing here at that commission meeting," he said.
Tom, a county staff official responsible for building-code outreach, told the commission the county had met with the Home Builders Association and left copies of the codes for review. "We had a meeting with the home builders of Mobile about a month ago, and they had a packed house," he said, adding that staff made local revisions to account for climate and other local conditions and that the state energy code provisions will remain in place.
Commissioner Ludwig and other members asked that the resolution language be changed so the effective date is not set before the public hearing. The commission's procedural motion was to rescind the prior approval and re-advertise the proposed adoption with the public-hearing schedule described above; the motion was moved and seconded and carried on voice action as recorded in the meeting, with no roll-call tallies provided in the transcript.
Because the advertisement and hearing will be public, staff said there will be an identified contact in the building office for contractors with questions. The commission asked staff to correct the resolution language to make the sequence—advertisement, public hearing, then adoption—explicit.
