County engineering staff told the court the entry curve nearest the railroad and pipeline could not meet normal 35‑mph design radii without encroaching on constrained infrastructure. The court authorized a targeted exception allowing the horizontal curve near the railroad to be designed to a minimum 300‑foot radius (with engineering to assess whether a 333‑foot radius could be achieved) and allowed the boulevard section’s first approximately 1,000 feet to be designed to a 30‑mph standard, rather than the typical 35‑mph collector standard, provided specified drainage, ditching and median stability measures are met.
Staff emphasized several conditions the developer must satisfy before final approval: verify or cure sanitary control easements shown on the plat; confirm required fire protection and sprinkler considerations with the local ESD; ensure drainage cross‑sections and hydrology studies accommodate proposed ditch depths and that any right‑of‑way or easement conflicts are resolved. Commissioners said they did not want to adopt inaccurate easement information and directed staff to return corrected survey/easement documentation if needed.
What happens next: County staff will mark the engineering conditions and return a redlined plan and letter to the developer for correction. The developer must address easement and drainage items before the court will finalize the plat recording.
