Floyd County approves $207,750 mediation payment to New Albany in animal shelter dispute

County Attorney Christie Fox told the Floyd County Commissioners on April 21 that a mediation agreement with the City of New Albany calls for Floyd County to pay the city $207,750 within 30 days to settle a dispute over the animal shelter building. "Floyd County will pay the city of New Albany the sum of $207,750 within 30 days of the agreement," Fox read aloud to the board.
Under the agreement the city may occupy the building through Dec. 31, 2027, or leave sooner if its new shelter is completed, Fox said. The city will be responsible for utilities, maintenance and for carrying insurance that names Floyd County as an additional insured; the county will not charge lease payments during the occupancy period.
The $207,750 figure represents the city's 50% share based on the average of two appraisals, Fox said; the payment is intended to resolve claims arising from prior litigation over the facility. Commissioners discussed the mediation outcome as a way to move forward cooperatively; one commissioner described the result as "win-win." The board voted to approve the mediation agreement.
The agreement also specifies that each party will pay its own attorneys' fees in the related litigation. The county's formal action was limited to approving the mediation terms as summarized in open session; the full settlement documents will be finalized and executed according to the agreement's timetable.
