The Waxahachie Planning and Zoning Commission on July 29 recommended approval of a specific-use permit allowing short-term rental use at 313 Highland Avenue (ZDC-78-2025).
Staff told the commission the primary structure at 313 Highland is about 1,072 square feet, contains three bedrooms and has improved surface area to accommodate the maximum three off-street parking spaces allowed. Staff reported no short-term rental operation at the property in the previous 12 months, said 44 notices were mailed to property owners within 500 feet to comply with state law, and noted two letters of support and zero letters of opposition were received. Staff also said the listed emergency contact will reside roughly 13.7 miles from the subject property. "Staff has recommended two motions regarding this item located in your packet tonight," the planner told the commission.
Applicant Matthew Mitchell, who identified himself and gave a home address in Maypearl, said he has owned the property for two years and that it has been used as a long-term rental during that period. "After cleaning it up, after the last person moved out of it, we'd like to keep taking care of it ourselves," Mitchell said.
With no members of the public speaking for or against the application, the chair closed the hearing and a commissioner moved to recommend approval "subject to the conditions of the staff report, authorizing the city manager and our mayor to execute all documents accordingly." The motion received a second and carried on a voice vote; individual roll-call votes were not recorded in the meeting transcript.
The commission's recommendation advances the application to the next step in the city's approval process; the staff packet and the commission's motion reference conditions of approval in the staff report. The applicant and staff may be required to return to a subsequent meeting if those conditions need verification before final administrative action.
