Council denies Specific Use Permit for specialty paraphernalia shop at 1702 W. US 287

The Waxahachie City Council voted to deny a proposed Specific Use Permit that would have allowed a specialty paraphernalia business at 1702 West U.S. Highway 287 Business, Suite A.

Planning staff told the council the request (ZDC 110-2025) required an SUP under local code and that staff and the Planning and Zoning Commission recommended denial because the use was incompatible with surrounding commercial and medical uses; staff said it received six letters in opposition and zero letters of support.

Owner Daniel McGee and manager Virginia Rosa described prior retail and bail bond experience and said they would install security cameras, control entry and limit the footprint to Suite A. McGee said he had trouble obtaining a certificate of occupancy and utilities during the application process and asked for guidance on permitted uses.

Council members and nearby property owners raised concerns about the site’s proximity to pediatric and dental offices, its location at a principal entry point to the city and the potential for what one council member called an unsuitable “next-level” paraphernalia use that could include products with THC. A resident who owns nearby property said the change would negatively affect property values and neighborhood character.

A council member moved to deny ZDC 110-2025 and the motion carried. The denial leaves the current zoning and permitted uses in place; staff offered to meet with the applicant about permissible alternatives for the property.
