The Rosenberg City Council on Dec. 16 approved resolution R-4010, authorizing the city manager to negotiate and execute a development agreement with Clock Investment LLC for a roughly 6.638-acre tract located at the northwest corner of Stellar Road and Baymoor Road in the city’s extraterritorial jurisdiction.
Staff said the owner intends to develop the tract for commercial uses, including a convenience store and fuel station with or without a car wash, and that the agreement will require the owner to extend water and sewer lines, purchase water and wastewater services from the city, and adhere to use restrictions spelled out in the agreement (the staff presentation enumerated prohibitions that include multifamily residential uses, vape shops and massage parlors).
Council discussed water-rate limits for ETJ (staff said the city's ordinance sets a 1.5× city rate as a reasonable ETJ charge), confirmed that the agreement does not force annexation and noted that use restrictions would apply to the property in the ETJ. After a motion to approve by Hector and a second by Steve the council voted by voice to adopt resolution R-4010.
Council later tabled Item 7 (a separate developer item) at the developer’s request so outstanding details could be worked out; staff and council discussed the procedural options for bringing the item back (either specify a return date or have four council members request it be returned).
