Charter review panel adopts clarified definition of 'conviction' for eligibility and sends recommendation to council

The Charter Review Committee approved tightened language to clarify when a criminal matter counts as a "conviction" for purposes of eligibility to hold office and forwarded that recommendation to the City Council.

The city attorney told members she had "tweaked the eligibility section" to add a sentence specifying that "conviction includes a finding by a court after trial or a plea of guilty or nolo contendre regardless of the sentence received, suspension of the sentence, or a withholding of adjudication." She said the provision mirrors language already used elsewhere in the charter to account for the many ways criminal matters can be resolved in different jurisdictions.

Alicia, identified during the meeting as a former prosecutor, told the committee the revised wording "covers it nicely" and emphasized she was not trying to push a particular outcome but wanted to flag potential issues to watch for. Committee members questioned whether the addition duplicated language in Article 2, and the attorney explained Article 2 governs suspension and reinstatement for sitting officials while the new sentence addresses initial eligibility, so the two provisions serve different purposes.

A committee member moved to accept the revised eligibility text as written and another member seconded. The chair called a voice vote and the motion passed; the committee accepted the wording as its recommendation to City Council.

The committee directed the city attorney to bring back any additional clarifications needed for related sections at a future meeting. The action is advisory to the City Council, which will decide whether to place the change on a ballot or adopt implementing language.
