Council overturns zoning board denial, allows carport at 1001 N. Whitman to remain

The Marion City Council voted unanimously to disapprove the zoning board’s denial and allow a 20-by-20 carport installed at 1001 North Whitman (Parcel 07-18-257-006) to remain despite the owner not having obtained a permit.

Mayor Absher, who said he visited the site and reviewed Google Street View, moved to overturn the zoning-board decision. Absher told the council the structure “does not have the proper setback” and that the zoning board “made the right decision” to follow rules, but that his on-site appraisal showed the carport posed no line-of-sight hazard and in some ways improved the property. He said the owner repaired a damaged sidewalk and had gathered letters of support from neighbors and the school district.

Council discussion acknowledged both the site visit findings and broader concerns about setting a precedent for after-the-fact construction. One councilmember said awarding relief in this case might encourage others to build before obtaining permits; another noted the lot’s unique circumstances as a one-way street and that the carport did not overhang the newly poured sidewalk.

The mayor moved to “disapprove the zoning board’s denial and allow this carport at 1001 North Whitman…to remain,” a motion seconded by a fellow councilmember. The roll call vote approving the motion recorded votes of Commissioner Patton, Commissioner Barwick, Commissioner Webb, Commissioner Stecklen and Mayor Absher — all voting in the affirmative.

The action allows the installed carport to remain; staff did not outline additional conditions in the meeting. If the council had upheld the zoning-board denial, the owner’s only recourse would have been removing the structure, the council noted.

The council moved on to later agenda items and the meeting proceeded to other capital and administrative matters.
