Under the current structure, businesses may buy a tax credit equal to 50% of their donation; the statute caps credits at $350,000 per year (a $700,000 donation base per year), Lang said.
The bill proposed that donations smaller than $50,000 could be processed without governor and council review so the business donor receives a certificate more quickly and the Arts Council receives funds faster. Lang said the change is to remove a mechanical delay that arose when the program first began receiving donations to an agency fund rather than to a quasi‑public entity.

Lang said many theaters or arts organizations could already add a voluntary checkbox at ticketing, and he repurposed this bill to address a mechanical problem after discussing options with the sponsor group.
