City engineer says Legacy Drive paving delayed by utility design constraints

The city engineer reported that planned paving and stormwater work for Legacy Drive are on hold after the contractor (WePave) rejected two submitted designs that failed to meet the contractor’s utility-cover requirements.
The engineer said the existing utility owner has told the city it will not allow more than five feet of cover over its pipe, which makes the proposed storm-pipe alignment and required roadway profile physically infeasible. "They don't want more than 5 feet of cover over their pipe," the city engineer said, adding, "We actually can't fit concrete pipe in there and we need a 48 inch not 6." She said the contractor earlier indicated that greater cover (8–9 feet) might have been acceptable but the most recent requirement of 5 feet means the current designs will not work.
Why it matters: the Legacy Drive segment is part of this year’s capital-improvement program (CIP). The council was told the item must be reworked so the collector roadway can be built without conflicting with the existing utility pipe and its required cover. The engineer said staff have provided two alternate designs to WePave that were rejected and that alternate solutions are being developed to move stormwater around the constraint.
Council members asked about the paving schedule. The city engineer said the timing is uncertain because no one from the paving contractor was on-site that day; she said staff will reach out to Rochester Sand and Gravel to confirm availability. "I'm just not sure about their actual schedule right now," she said, while noting the expected staging if the work proceeds this year: first course, trail, then wear course.
Next steps: staff will continue developing alternate designs to address the pipe-cover limitation and will contact local contractors to clarify scheduling; no formal vote or funding decision occurred on Legacy Drive during this meeting.
