The Defiance City Council unanimously adopted a resolution declaring the services the city will provide upon annexation of 6.972 acres requested by the Fort Defiance Humane Society for a new facility.
Law Director O'Donnell told council the request constitutes a type 2 annexation and cited Ohio Revised Code §709.023(c), which requires the municipal legislative authority to adopt a resolution specifying services the city intends to provide and approximate dates for those services. He said the parcel lies on the south side of Elliott Road and that existing infrastructure in the corridor would make serving the parcel feasible.
Council moved and seconded the resolution on the floor; members recorded affirmative votes and the president declared the resolution adopted.
The resolution expresses the city’s consent to annexation and establishes zoning restrictions and the services the city will provide if and when the annexation proceeds; the county board of commissioners must also receive the resolution before the annexation can move forward. Council did not specify the exact timeline for each service in the meeting beyond noting an approximate date would be provided as required by state law.
