Richard Shagley, an attorney with Wright Shagley & Lowry, presented the petition on behalf of property owner Rick Lazier and said the properties (including 3317 North 12th Street and 1205 Fort Harrison Road) are currently zoned R-1 and the petitioner requests rezoning to C-2 for business and professional office use. Shagley said the area-plan staff recommended approval with conditions and that the area-plan meeting had no opposition.
Councilmembers asked about adjacent uses and site conditions; Shagley described Fort Harrison Road as a heavy commercial corridor, noted a nearby health clinic, and acknowledged a single residential lot abutting the property. The petitioner said the potential owner understands and will comply with area-plan site requirements.
Councilperson Chalo moved the ordinance and councilperson DeBond seconded. President Dinkel put the question: "All those in favor, say aye." The ayes carried and the council adopted Special Ordinance 3 20 26 on second reading.
The adoption was a formal land-use approval and occurred after area-plan review; no public opposition was recorded during tonight's hearing.
