The West Lafayette City Common Council voted to amend a footnote in the Discovery Park District overlay (ordinance O8-20-26) on April 6, allowing the administrative officer of zoning to grant discretion in whether projects must meet a 100% first-floor commercial requirement.
Chad Spitzenau, the city’s housing director, said the amendment stems from practical development obstacles encountered under the existing overlay and is intended to allow more projects to proceed by-right without full planned development rezonings. "If we were to expect commercial use on all that [hashed area], it would be a big fine and really hard for them to develop," Spitzenau said, explaining that AO discretion would be exercised case by case and would still consider street context, parking and proximity to existing commercial corridors.
Council members pressed for safeguards, asking whether the city would retain leverage to negotiate public benefits through planned developments and whether a numerical commercial-floor threshold should be set. Spitzenau said the AO discretion was intended to avoid repeating full rezoning work for minor adjustments and noted the city could still require a PD or rezone where appropriate.
During public comment, multiple residents urged the council to reject the change or at least preserve stronger public-review mechanisms. Zachary Veil told the council the proposed amendment "would make the CBW zone in the Discovery Park District optional and at the discretion of the West Lafayette administrative officer" and warned that the district "could quickly become the most residential district," removing public hearings and accountability.
After discussion, the council approved O8-20-26. The ordinance amendment will permit administrative flexibility on first-floor uses in certain cases; the AO retains authority to grant or deny exceptions and staff said they will report back with requests that come in under the new standard so council can monitor outcomes.
Next steps: Planning staff will track requests for AO discretion and provide updates to council as projects are proposed under the amended overlay.
