Senator Hoffner told the Senate Executive Committee that Senate Bill 282, a cleanup to Delaware’s wrongful-conviction compensation statute, corrects drafting errors that unintentionally capped attorney fees and misdirected payment authority.
"In the middle of the bill, we were capping attorney fees, and that was not our intent," Senator Hoffner said, and added that payouts should come from the Office of Management and Budget rather than the State Treasurer.
Committee members thanked Hoffner for addressing the drafting issues and noted the changes arrived late in the process. Hoffner said a substitute will be presented on the Senate floor the following day to implement the corrections. The chair noted there was no public comment on SB 282; no member moved a final vote on the bill during this meeting.
The committee recorded that the bill will be circulated for further consideration. No formal action or vote on SB 282 was taken in committee during this session.
