Benton City Council voted June 3 to approve conditional-use permit CUP-25-01, clearing the way for a two-story, 2,842-square-foot fourplex on Lot 2 of Short Plat 3782 at 11th Street and Karen Avenue.
Staff presented the planning commission’s recommendation and site findings, noting the R-2 zoning, a proposed 10 paved parking spaces (including one accessible stall), on-site stormwater collection and infiltration, and required curb, gutter and road improvements per the municipal code. The record includes requirements for hydrants and other fire-protection measures.
Neighbors who testified said prior stipulations discussed at the planning commission — including drainage measures, placement of rock in the easement and a retaining wall — must be enforced. Pedro Paniagro, who said he lives at 1307 9th Street, told the council he has photos and video he said show a worker using an excavator to move dirt from his land onto the applicant’s property and asked that the council ensure the applicant abides by earlier commitments. Another neighbor who identified herself as Tammy said contractors must know exact property lines to avoid repeated encroachments.
Council members pressed staff and the applicant on site geometry, parking and emergency access from undeveloped Karen Avenue. One council member recommended a minimum 12-foot travel lane plus an 8-foot parking lane with curb and gutter to improve access and public safety; staff said the applicant will be required to construct streets and stormwater systems to city and state standards and to follow the engineer’s recommendations.
After discussion, a council member moved to approve CUP-25-01 with additional findings and conditions; a second was recorded and the motion passed on voice vote. Staff said the planning commission records and the engineering solutions will be part of the permit and building-permit conditions.
The council’s action allows the applicant to move forward subject to the council’s conditions, building‑permit review and compliance with the engineering and planning requirements noted in the record.
