Council hears EPA-approved sewer-use changes, tables resolution to review ordinance concurrently

City staff presented proposed amendments to Chapter 52 (sewer use), an Enforcement Response Plan and a Statement of Legal Authority that the United States Environmental Protection Agency reviewed and approved. The changes, staff said, include tightened pollutant limits (notably for metals), clarified definitions, and stronger enforcement language to support the city's industrial pretreatment program.
Staff reported Valparaiso has 44 industrial users, four of which are categorized as significant industrial users (SIUs). Staff explained SIU criteria (e.g., discharges of 25,000 gallons/day, categorical industrial sectors, or a reasonable potential for harm) and said the updated documents provide tools for oversight, compliance plans, agreed orders and fines.
Council members sought context: they asked whether the city had been operating under the newer standards during the long back-and-forth with EPA and requested specifics on the magnitude of tightened limits and the program's compliance history. Staff said the documents had been in development for many years, that delays were partly due to EPA staff turnover and federal response time, and that the new language strengthens the city's enforcement capacity.
On procedural grounds, some members recommended sequencing first reading of the ordinance before finalizing the resolution; after discussion the council moved and approved a motion to table Resolution 2 until the ordinance is brought forward for final reading so council can consider them together. The ordinance was introduced for first reading and will return for final action at the next meeting.
