St. Charles tables $500,000 directional-boring award after bid-clarity concerns and public protest

The Committee of the Whole tabled a proposed award for directional-boring services after extended questioning about the bid evaluation and what staff described as non-responsive bids. Staff recommended awarding the three-year, unit-cost contract (annual budget shown at roughly $500,000) to Archon Construction, citing that two lower bids contained exceptions or were incomplete for the unit-price structure.

Councilmembers pressed staff for more detail on why York Utility and Fairway Electric were judged non-responsive and asked whether the city could clarify bids with contractors after opening. City legal counsel explained procurement laws limit post-opening clarifications and that addenda and questions remain the pre-opening mechanism for clarifying scope.

Councilmember moved to table the award to next Monday to allow staff to contact bidders and ensure each bidder had the same opportunity to confirm whether exceptions existed and to provide apples-to-apples comparisons; the motion was seconded and passed on a roll call.

During the public-comment period Michael Carney, owner of York Utility Services, disputed staff—haracterizations, saying York was the incumbent and that "there was 2 year options on the contract... We met every requirement." Carney also objected to the non-responsiveness finding and said prior escalations would have amounted to small totals over prior years.

Staff said tabling would allow them to revisit bid materials and ensure fairness; the award remains tabled pending staff follow-up and a scheduled reconvening next Monday.
