Board reopens review of campground special-use permit and sends application back to planning commission

At the continued meeting, the Nelson County Board of Supervisors voted to reconsider the planning commission's April 14 denial of special-use permit (SUP) #250263, a proposal for a campground on Morris Lane (tax map parcels 765-4 and 765-5), and then voted to send the application back to the planning commission for further review.
Planning staff Dylan explained the applicant had filed correspondence claiming the planning commission's 3–2 decision was "arbitrary and capricious," based on neighbor complaints and personal comments rather than established SUP criteria. Dylan cited Nelson County code §2-52(f), which allows a member to move for reconsideration at the same meeting or a continued meeting, and outlined procedural options if the board adopted reconsideration.
One supervisor said the motion to reconsider was a "legal maneuver" intended to "cover everyone's behind" and to give the planning commission a chance to reexamine the case and return it to the board if appropriate. The motion to reconsider passed on a roll-call vote. A follow-up motion to send SUP #250263 back to the planning commission for further review was made, seconded and approved; staff noted that a second public hearing before the board could occur if the planning commission returns the item to the board for a decision.
Next steps: the planning commission will re-review the SUP if requested, and if the application returns to the board it may trigger another public hearing.
