Town staff explained the building had been subject to an unsafe-building action after inspections found a broken door and interior damage. Drew Wilson, the town's code enforcement officer, said the unsafe-building work began after an initial finding on 03/03/2025; the town left a corrective notice, performed weekly inspections and ultimately purchased supplies and boarded the front door and broken window on 11/26/2025 to prevent injury. "The emergency action was for us to board up the building, board up the windows so no one had access to the building where they could go in there and get injured," Wilson said.
Staff said certified letters had been mailed; two were signed for (the property owner's attorney, Pat Rooney, and the registered agent) but the property owner, 3 Brothers LLC, did not respond. Town staff said the council previously approved administrative processing costs and that the town would attempt to recover corrective-action costs, including filing a lien if payment is not received. Staff described $295.46 as the material and notice cost specific to the emergency boarding action the commission was being asked to affirm; other administrative and contractor costs were addressed separately and previously by council action.
Commissioners asked whether taxes were current and whether the property might be declared abandoned under statute; staff said taxes were current for the amount due in May and that abandonment determinations depend on multiple factors, including ongoing unsafe-building conditions. After discussion, the commission voted unanimously to affirm the emergency action and the $295.46 cost the town seeks to recover. The town indicated it will take additional corrective-action costs and previously approved administrative costs to the property owner and may place liens if unpaid.
The motion affirmed the emergency action for UB26-011 at 1137 North Avon Avenue and authorized staff to pursue cost recovery procedures consistent with town code.
