Summary
The Clay County Board of Adjustment unanimously approved a variance to exceed the 30% lot-coverage limit by 987 square feet to permit a solid roof over a pool at 4231 Magnolia Road (Doctors Lake); staff recommended approval and the board voted 5-0.
The Clay County Board of Adjustment voted 5-0 on April 30, 2026, to grant a lot-coverage variance allowing a solid roof over an existing pool at 4231 Magnolia Road in the Doctors Lake subdivision.
Planning staff presented BOA26-004 on behalf of applicants Dr. Eugene Harrell Makovsky II and Sabrina Makovsky and their agent, noting the request would increase the parcel’s lot coverage by 987 square feet above the 30% maximum. Staff recommended approval, saying the proposed roof sits between existing structures and would have minimal expansion into the rear yard and would not materially affect neighboring viewsheds if runoff is directed away from adjacent property.
Clayton Hartwig, who identified himself as the agent’s son and spoke for the applicant, said the project will keep the enclosure sides intact and "they're putting on a roof to help with their health." Board members calculated the resulting lot coverage would be about 33.3% and observed the change would be most visible from the water or by aerial view rather than from adjacent yards.
A board member moved to approve the variance and another member seconded; the motion passed 5-0. Staff will record the variance and the requirement that drainage not adversely impact neighboring properties.
The item closed with routine procedural remarks and the board moved on to other business.
