The Winnebago County Board of Adjustment voted Jan. 8 to grant a variance allowing a zero-foot setback at 5298 San Jose Road so the property owner can build an ADA-compliant access path to lakeside docks and restrooms.
The staff member who presented the request said the change would replace a grass approach with a solid surface and "make it easier for people using ADA parking stalls to access the lake and restroom." The board was told the project has received a grant and that required permits — zoning, sanitary and erosion-control — must be obtained before construction begins.
During deliberation the staff member reviewed the variance criteria in the shoreland zoning code and recommended findings that the request meets the standards. "Based upon the above findings, it is the opinion of the board that all criteria of Article 7, Division 12, Section 23.7 through 2 34, Town County Zoning Code, have been met," the staff member said, adding that the request would not harm the public interest and is intended to increase accessibility.
A motion to approve the variance and the staff findings carried on roll call. The board clerk read recorded votes in favor as Susan, Tom Junan, Tom Senior and Greg (four in favor). No oppositions were recorded on the transcript.
The board noted no advisory staff conditions but reminded the applicant that all applicable permits must be obtained prior to starting work. The variance approval authorizes the setback relief only; precise construction timing and permit compliance were described as matters for later administrative review.
