Winnebago County reports missed leachate sample to Oshkosh; staff says enforcement unlikely

Winnebago County staff reported that the county received a notice of violation on Jan. 5 for missing a required quarterly leachate sample that is submitted to the City of Oshkosh as part of a wastewater discharge permit. The missed sampling stemmed from a construction project that required temporary uninstallation of sampler equipment.
Ryan Bieber (S2) explained staff reinstalled the sampling equipment, took the missed sample on Jan. 19 and submitted it before the Jan. 31 deadline along with a written response explaining the circumstances. "We submitted everything that we need to to respond to the violation well before the deadline," he said, and noted ongoing communication with the City of Oshkosh pretreatment coordinator, who had expressed understanding of the sequence of events.
Staff said they anticipate the occurrence will be concluded without enforcement action or penalties because the sample was submitted and corrective steps were documented. The board asked whether similar sampling errors had occurred in the past; staff said no.
What happens next: staff will continue to monitor sampling schedules and complete any corrective paperwork the city requests.
