Lubbock County judge declares Precinct 2 seat vacant, appoints Mark Allen Muir

LUBBOCK, Texas — Lubbock County Judge Curtis Parish announced Monday that Commissioner Jason Corley’s November communications constituted actions that, in Parish’s reading of state law, triggered an automatic resignation from the Precinct 2 seat and appointed Mark Allen Muir to fill the vacancy.
Parish told the commissioners court that an email dated Nov. 12, 2025, and a text sent Nov. 15, 2025, constituted “affirmative action” indicating Corley was a candidate “in fact” under provisions the judge cited from the Texas Constitution (Article 16) and the Texas Election Code (section 2.51.0011). Parish read from the email and from a text he said Corley had sent, quoting in part: "my name is Jason Corley. I am the county commissioner for Lubbock County Precinct 2. I'm running for congress in Congressional District 19." Parish then said, “the office of Lubbock County Commissioner Precinct 2 is vacant by the automatic resignation of Jason Corley under the provisions of the Texas constitution and the Texas election code.”
Parish said he acted under the authority of Texas Local Government Code §87.042 to appoint Mark Allen Muir to fill the remainder of the term effective Dec. 8, 2025. Muir took the oath of office at the meeting. In his oath Muir said, "I, Mark Allen Muir, do solemnly swear that I will faithfully execute the duties of the office of Lubbock County Commissioner Precinct 2." The court then proceeded to regular business.
The declaration in court was based on the documents and messages Parish described; the record contains no immediate challenge or rebuttal during the meeting. Parish cited the constitution and election-code language describing when a candidacy constitutes an automatic resignation and listed examples of “affirmative actions,” such as forming an exploratory committee and soliciting support or campaign contributions. The judge named an 11/12/2025 media email that included campaign graphics and a Corley for Congress email address and a post office box.
What happens next: The court took no further formal action on the status of Corley during the meeting. Parish’s appointment of Muir was presented as effective immediately; Muir was sworn in and seated during the meeting.
