Board approves 1-foot-7-inch roadway setback for Milkweed Court utility building

The Northwell County Board of Adjustment on April 9 approved a variance allowing a 1-foot-7-inch roadway setback for a proposed utility building at 718 Milkweed Court, where the code requires a 30-foot setback.

Chair called the request and application number and board members discussed the narrow scope of the work and neighborhood impacts before voting. Committee member C described the project as ‘‘meant for the public utilities’’ and said it is sited next to an existing sewer lift station, which informed the board’s view of minimal additional risk to travelers. Several members noted landscaping and limiting construction to the area of the original concrete pad as conditions to reduce neighborhood impacts.

The board read and adopted findings for approval, stating the variance would not be contrary to the purpose of the zoning regulations and that the parcel’s configuration and proximity to utility infrastructure limited its ability to meet standard setbacks. The board referenced applicable code criteria for granting variances and advised that all requisite town and county permits, zoning approvals and erosion-control permits must be obtained before construction begins.

On a roll call conducted at the meeting, each member present voted in favor: Susan — aye; Jim — aye; Tom — aye; Greg — aye. The motion carried and the variance was approved with the town advisory conditions and county permitting requirements.

The decision closes the application for 718 Milkweed Court; the board moved to the next agenda item afterward.
