At a special called meeting, the Procurement Standards Board approved substitute language to regulation r.4.48, formalizing its conflicts-of-interest process and adding definitions and an appeal timeline, Chair Janine Reed said.
Wally Dietz moved the adoption and introduced the amendment, saying, "I have circulated an amendment to r.4.48, and I move that it be adopted." Legal counsel Laura Fox of the Metro Department of Law described the change as a formalization of an existing process: "We took the process and we put it into, basically just with numbers...and we posted that within the 10 days that we should post it for public comment." She added that the draft adds definitions of what constitutes a related project and clarifies factors the purchasing agent can consider when assessing potential conflicts.
Fox told the board the regulation also sets a timeline for appeals: "If they're not happy with the purchasing agent's decision, that they could appeal to this board," she said, noting a 10-day period for the appeal. The regulation, she said, is intended to make the conflict process easier to find and a bit more formal.
The chair called for a vote after discussion. The public transcript records aye responses and Chair Janine Reed announced, "Motion carries and the substitute language is approved." The audio/transcript does not include a roll-call tally or the name of the board member who seconded the motion; the record shows only verbal "Aye" responses.
