County attorney flags maintenance expectations in Platte River Road relinquishment as Highway staff report ongoing projects

Highway Superintendent Scott Huppert told the Dodge County Board on July 9 that crews are working on ditch cleaning for a FEMA grant, pothole patching, and overlay and panel repairs on Old Highway 275 and County Road 17. He said surveying and placement of utilities are the primary scheduling constraint on the Morningside Road project and that engineers are finalizing requirements for a railroad crossing at Shoreline Drive and County Road 6; Union Pacific has proposed closing one of its crossings in Dodge County.
Superintendent Huppert said engineers are marking right‑of‑way for culvert and shoofly work on F Road and are finalizing right‑of‑way for Project 643 (a box culvert on Luther Road).
County Attorney Hopkins raised concern about a relinquishment agreement with the State for Platte River Road that Dodge County previously accepted in 2014, saying the language "sets standards for the maintenance of the road that are applicable to the standards for a state highway" and appears inconsistent with what was communicated to the Board when the county accepted the road back. Hopkins said the State may be applying the higher standard to use the road as an emergency diversion off the Highway 30 Expressway.
The Board recessed for other business and no final action altering the relinquishment agreement was taken at the July 9 meeting; staff and the county attorney indicated continued work to clarify agreement language.
