Planning commission backs narrow Homestead setback cut to 10 feet near golf-course open space

The Midway Planning Commission recommended approval of a code-text amendment that would let certain resort-master-plan buildings in the Homestead reduce their peripheral setback to 10 feet when next to dedicated golf-course open space.
Staff member presented the application from Berg Engineering, agent for the Homestead Group, saying the proposal is narrowly tailored and would not change the citywide baseline setback of 100 feet for peripheral resort property lines. "This language is tailored pretty tight," the staff member said, noting only about seven buildings in the Homestead could take advantage of the amendment and that one of those is already under construction.
Commissioners pressed the applicant and staff on potential effects, including whether smaller setbacks could enable larger structures and whether the code text could be used in other resort areas. "Could structures be larger because of this?" a commissioner asked. The staff member acknowledged the possibility but said the proposal includes findings and conditions at later design-review stages; applicant representative Ben Shakespeare said the intent was flexibility for grading and driveway design, not larger homes.
Gary Gorga, representing the Links HOA and a nearby resident, told the commission the adjacent golf-course land is held under a permanent easement and explained a clause that could return the land to the Links if the golf course closed for two years. Gorga said he understood the request and that the HOA had reviewed the proposal; the applicant said they had met with the Links HOA and were not seeking larger footprints.
A commissioner moved to recommend approval of the amendment, adding a condition that the size of structures not be increased as part of the change; another commissioner seconded. The motion carried; the planning commission will forward the recommendation to the City Council for final action.
The staff presentation and public hearing materials identify the Midway Land Use Code section at issue (16.15.040.d.11.c). The planning commission recorded the recommendation and closed the public hearing; the City Council will receive the recommendation at a future meeting.
