Board unanimously approves setback variances for Spirit Lake lakeside lot

The Dickinson County Board of Adjustment voted unanimously Monday to grant multiple setback variances for a lakeside lot in Spirit Lake.
Brian Van Bruggen, representing the new owners, told the board the plan squares off a structure and shifts it 1 foot east to increase separation from neighboring Lot 17. He said the proposed building width is 19 feet 6 inches and described a reduced overhang and roof pitch to limit encroachment.
Board member Alex Oponski moved to grant variances that would allow a rear yard of 4 feet (5 feet required), a west side yard of 0 feet (3 feet required), an east side yard of 2 feet (3 feet required), and a front yard of 13 feet (14 feet required). Kirby Berhow seconded the motion; the board voted 5–0 in favor.
Board members asked technical questions about overhang, gutters and utility placement. Van Bruggen said the propane tanks would be removed and that HVAC work would include installing a gas meter; he described a roughly 3.9‑foot west clearance for the installation. Clark and Berhow said the proposed adjustments were reasonable and that squaring the structure would be an improvement for neighbors.
The board recorded correspondence from multiple nearby owners (read into the record) before voting. With the motion approved, the owners may proceed with building plans subject to county permitting procedures.
