Board approves changes to code of conduct and photo policy after legal review

Tracy Robinson (District 4) moved that the board adopt a revised library code of conduct, and the board approved the change after staff explained legal advice requiring removal of a clause that had prohibited ‘‘using photographic video or other recording devices without library staff approval.’’

Amanda Dickman, the library director, told the board the language conflicted with legal protections for photographing and filming in public spaces. "It was brought to our attention that, it is a First Amendment right to be able to photograph and take video in a public space, and that that is upheld in the state of South Carolina as a 1 consent state," Dickman said, and the board adjusted the code of conduct to reflect that guidance.

The board then moved and approved revisions to the photo release policy to remove language that restricted patrons from taking photographs of other patrons or staff without permission, with members noting that libraries are public spaces and the existing language had to be aligned with state law.

Tracy Robinson also moved to adopt revised donation and gift policies, including a new policy clarifying naming of libraries and library spaces; the motion passed. Board members thanked volunteers and the Friends of the Beaufort Library for their support in funding programs and StoryWalk installations.

All three policy motions were passed in open session; the meeting transcript records affirmative votes after each motion. The board did not identify any additional restrictions beyond those required by law and the revised policies will be reflected on library materials and posted notices.
