Magistrate clerks reclassified after district clerk assures duties and courtroom coverage

Commissioner Webb moved to approve the reclassification of magistrate clerks on the condition that the magistrate clerks continue to perform all current duties and the duties used to justify the reclassification. The motion was seconded and carried 5-0.
District Clerk Gold addressed the court, saying the reclassification request did not change the two-days-of-court scheduling that had been discussed and that courtroom coverage would remain in place: “I can make that commitment Judge, I've already made the determination that we're not going to take anybody out of the courtroom, we're going to leave somebody in that courtroom every Tuesday and every Thursday.” Gold added that additional quality-control work and reporting requirements tied to SB 9 and DPS audits increased the clerks’ responsibilities and were part of the reason for the reclassification.
Commissioners asked whether additional overtime or other hours would be necessary for quality control; Gold said the need for overtime was under advisement. After discussion and the District Clerk’s assurances, the court approved the conditional reclassification 5-0.
Next steps: staff will proceed with the approved reclassification while monitoring workload and any overtime needs tied to new reporting requirements.
