Court approves waiver for man camp preliminary plat, sets performance bond and expiration

Callahan County Commissioners Court approved a waiver request for a preliminary plat related to a man camp submitted by North Texas Contracting, the court announced during its March 9 meeting.

The presiding officer read an order prepared by county attorney Jim Allison that, the court found, incorporated a complete property description, a detailed waiver request and a performance bond intended to cover any necessary clean-up costs when the camp is vacated. The court voted to approve the waiver, which the order specifies will take effect immediately and will expire on 2028-04-01 unless the commissioners vote to extend it.

The court's packet divided the materials into the waiver request, attachments and the proposed order; the chair said the order was drafted to be specific to this project and not a precedent for other proposals. The order, as read, stated that the facts set forth in the recitals were true and that approval would "further the general welfare of the county and its citizens." The county incorporated the executed performance bond into the order to secure compliance.

The court voted on the motion to approve the order after a motion and a second were recorded; S1 announced the motion passed with no opposition. The order and related materials were referenced in the meeting packet and will be part of the county's record on the project.

Next steps: the waiver will remain in effect through April 1, 2028, unless the commissioners extend it. Any enforcement or post-occupancy cleanup referenced in the bond would proceed per the terms included in the order.
