Peter Lowenstein presented the proposal and said the changes are intended to bring the municipal code into statutory conformity with AB 540, passed by the Nevada Legislature in 2025. “This bill amends LVMC 19.17 and 19.18 to revise the term…from affordable housing to attainable housing throughout those chapters, and we'll update attainable housing tier description to conform with assembly bill 540,” Lowenstein said.
Lowenstein added the bill would also amend bonuses and incentives for attainable housing projects and clarify procedural aspects of fee or tax reimbursement for qualifying projects. The committee opened the public hearing, heard no public comment, and moved to recommend approval. The item will be scheduled for adoption at the City Council meeting on May 20, 2026.
If adopted by Council, the municipal code would be updated to the new terminology and related incentive criteria as described by staff.
