SB 1075 moves forward after tense hearing over AB 617 implementation and development impacts

Sen. Reyes presented SB 1075, a measure aimed at improving implementation of AB 617 community emission reduction plans (SERPs) by asking local governments to consider SERPs’ recommended measures when approving certain industrial and commercial land‑use actions in identified overburdened communities.
Phoebe Seton of the Leadership Council for Justice and Accountability and Katie Valenzuela of the Center on Race, Poverty, and the Environment told the committee that SERPs have too often been honored in name only and that implementation gaps have left frontline communities exposed to diesel and industrial pollution.
John Kendrick of the California Chamber of Commerce and representatives of counties, cities, builders and employers expressed opposition or concern, saying the bill would create added uncertainty and litigation risk that could deter investment in the very communities the bill seeks to help.
The author and the committee negotiated amendments to require local governments to "consider" SERP measures (rather than a more prescriptive alignment) and to consolidate analysis with CEQA where duplication existed. After debate, the committee moved SB 1075 as amended to Appropriations with a recorded 3‑2 vote.
