Council approves two Buchanan Street overlay ordinances despite calls to delay

The Metropolitan Council of Nashville and Davidson County on March 17 adopted two zoning-overlay ordinances applying commercial compatibility rules to parcels on Buchanan Street, amid public pleas to delay action until the state legislature finishes considering related property-rights legislation.
Elliot Perry, a District 21 resident who lives near Buchanan Street, urged the council to postpone the ordinances by a matter of weeks so the body could decide with the “full legal framework in place,” pointing to pending state bills (SB1908/HB1837) that he said could give property owners compensation rights if local regulations reduce property value. “If you move forward, you are making a conscious decision that property owners on Buchanan Street will not have access to protections that may be available to other property owners across Nashville just weeks from now,” Perry said.
Sponsor council members presented planning and zoning committee reports recommending approval. Council member Welsh said she was not comfortable supporting the measures given the state-level uncertainty and public comments asking for caution; she recorded an abstention. After a recorded machine vote, the council approved BL 2025-1168 (approximately 15.58 acres between 21st Avenue North and I‑65) and BL 2025-1169 (approximately 4.17 acres between 24th Avenue North and 21st Avenue North) by identical tallies: 31 votes in favor, 1 vote against, and 1 abstention on each ordinance.
Planning and zoning committee chairs explained the measures would apply commercial-compatibility overlay standards to the designated parcels; supporters said the overlays aim to manage new development and preserve neighborhood character. Opponents and several public commenters said the timing could leave Buchanan property owners disadvantaged if state law changes soon.
The council allowed members to remove the items from the consent agenda for separate consideration after multiple public speakers—business owners and residents on Buchanan—requested deferral. After discussion on the floor, members voted on the ordinances individually and adopted both on third and final reading.
The ordinances now take effect under Metro’s normal implementation rules for zoning changes; council records show the votes and the finalized ordinances will be filed with the Metro Clerk.
