Planning commission approves series of waivers and permits, expands pump station and elects new chair

The Henderson Planning Commission approved a broad set of land-use applications at its January meeting and elected new officers for 2026.
The commission granted final approval for the two‑part Boulder And Magic Building C application (CUPE 2025017780 and associated design-review amendments) to allow a restaurant with a face-to-face drive-through and revised site and building design at 2125 South Magic Way; the applicant (Luis Flores) agreed with staff’s recommendation and the item passed on motion. The commission also approved a 24‑month short‑term conditional use permit for Mosaic West Henderson to allow temporary rock crushing to prepare a development site; the applicant confirmed crushing would observe construction hours (6:00 a.m.–4:30 p.m. Monday–Friday) and the commission approved CUP 2025017970 subject to findings and conditions.
Other approvals included vacation of public right-of-way sections related to Bruner Avenue and Gillespie Street (VAC 2025017939) and a separate right-of-way vacation east of Grand Cadence Drive (VAC 2025017954), both forwarded to city council where applicable for final action. The commission approved an 18-foot retaining-wall waiver for the NEO Project (WOS 2025017976), waivers and design review for a pump station and R‑68 reservoir to serve the Lakemore community (CUP 2025017926/DRA 2025017925), and waivers for PAM Rehabilitation Hospital reducing required parking from 158 to 120 spaces (WOS 2025017950/DRA 2025017949).
The commission also granted CUP and design-review approvals for a vocational dog-grooming school at 2 Utah Way and approved a conditional use permit for an Avis Budget car-rental location after staff noted a memo increasing allowable on-site rental vehicle storage from 20 to 43 spaces; counsel said Avis will address licensing and any back fees once the CUP is granted. A series of residential setback and accessory‑structure waivers (including items for Rose and Morgan properties) were approved with findings and conditions.
In officer elections, the commission voted to make Commissioner Jennifer Lewis chair starting next month; Commissioner Beeson was elected vice chair after a separate vote. The outgoing chair thanked staff and adjourned the meeting.
Most items were final action of the planning commission unless appealed; several applications will be forwarded to the city council where required by code.
