Toms River council pauses on resolution to halt municipal prosecution of Silverton First Aid after heated confrontation

A surprise resolution on April 8 directing township officials to withdraw authorization and support for litigation against Silverton First Aid drew an acrimonious exchange between the mayor, council members and public attendees before the council voted to table the item.

The proposed resolution, read into the record by the chair, said the council found that the continued prosecution of the Silverton First Aid matter did not serve a legitimate municipal purpose and appeared politically motivated. It directed the municipal attorney to take steps to dismiss or terminate the litigation and prohibited further municipal funds from being expended on the matter, except as necessary to effect an orderly termination or comply with court directives.

Council members and the public responded with sharp disagreement. One council member warned the panel to be careful about conflicts of interest on a resolution that affects large sums and involvement of municipal officials; others accused colleagues of politicizing the issue or of failing to pursue alleged financial recoveries. The exchange included personal accusations and heated interruptions that required the chair to restore order.

After argument about conflicts and procedural fairness, a motion to table the resolution was made and seconded. The motion to table carried on a recorded roll call, and council leaders said they would revisit the matter after reviewing any potential conflicts and ensuring appropriate process. No further municipal funds were authorized in open session to change the status of the Silverton litigation during the meeting.
