Templeton Board advised to correct tobacco cap and consider limiting nicotine pouches to 6 mg

At the May 5 meeting the Town of Templeton Board of Health reviewed proposed updates to the town's tobacco regulations and heard a detailed presentation on oral nicotine pouches and retail-density provisions.

The presenter advised the board that the local regulation contains contradictory language: the first paragraph implements a straight cap, while a second paragraph appears to enact a retiring cap. She recommended correcting the local regulation so it reflects the board's intent and suggested incorporating updated state-law language where relevant.

The presenter recommended restricting oral nicotine pouches to a maximum of 6 milligrams and said boards typically must hold a public hearing before enacting such a restriction. "We're looking to restrict oral nicotine pouches to 6 milligrams," she said. She explained that although pouch products can list lower milligrams than combustible cigarettes, absorption through the digestive tract can deliver high nicotine doses and that poison-control calls nationally have risen sharply for nicotine exposures.

The presenter outlined enforcement options and penalties: Massachusetts law prohibits sales of tobacco products to minors and local fines for sales to minors can range from $1,000 to $5,000. She offered to provide a full, color-coded draft tailored to Templeton and to return for a presentation at the board's next meeting; the board expects a public hearing after staff circulates the proposed language and notifies retailers.
